Part I — Booking Terms & Conditions
These Booking Terms & Conditions ("Terms") govern all bookings made through Above the Standard Travel ("we," "us," "our Agency") for travel products and services, including flights, accommodation, cruises, tours, transfers, car rentals, travel insurance, and package holidays ("Travel Services"). By making a booking, you ("the Client," "you") agree to be bound by these Terms, together with our Payment Terms & Conditions (Part II of this document) and Privacy Policy.
1. Definitions
"Booking" means a confirmed reservation of one or more Travel Services made through the Agency.
"Supplier" means the airline, hotel, cruise line, tour operator, car rental company, insurer, or other third party actually providing a Travel Service.
"Lead Traveler" means the person who makes the Booking and who is responsible for all payments and communications on behalf of all travelers named on the Booking.
"Package" means a combination of two or more Travel Services (e.g., flight + hotel) sold together as a single price, where applicable under relevant package travel regulations.
2. The Agency's Role
Above the Standard Travel acts as a booking agent/intermediary between you and the Suppliers of the Travel Services you purchase, unless we expressly confirm in writing that we are acting as the tour operator or principal for a specific Package. Erica McEachern is a Travel Advisor and independent contractor affiliated with Atlas Coast Travel Group (ATLAS COAST VENTURES LLC DBA: ATLAS COAST TRAVEL GROUP), a registered Florida Seller of Travel (Ref. No. ST46588).
Your contract for each Travel Service is with the relevant Supplier, and that Supplier's own terms and conditions, fare rules, and liability limitations apply in addition to these Terms. In the event of a conflict, the Supplier's terms govern the specific service they provide.
We select Suppliers with reasonable care but do not guarantee their performance, and we are not liable for a Supplier's acts, errors, omissions, delays, cancellations, insolvency, or failure to provide the Travel Service as booked.
3. Booking Process and Confirmation
A Booking is not confirmed until you receive a written confirmation/itinerary from the Agency and any required deposit or payment has been received (see Part II — Payment Terms & Conditions).
The Lead Traveler is responsible for: ensuring all names, dates, and details provided match travelers' passports/government ID exactly; reviewing the confirmation/itinerary promptly upon receipt and notifying us immediately of any errors; and relaying all Booking information, terms, schedule changes, and Supplier communications to all other travelers on the Booking.
We are not responsible for losses arising from incorrect information supplied by the Client (e.g., misspelled names, wrong dates of birth), where such errors result in Supplier fees or denied boarding/check-in.
4. Travel Documents, Passports, Visas, and Health Requirements
It is the Client's sole responsibility to ensure that all travelers hold a valid passport (with sufficient remaining validity as required by the destination, typically a minimum of 6 months beyond travel dates), any required visas, transit documents, and comply with health/vaccination requirements for all countries visited or transited.
The Agency may provide general guidance as a courtesy, but this does not constitute legal or immigration advice. Requirements vary by nationality and are subject to change without notice — always confirm directly with the relevant embassy/consulate or official government source before travel.
The Agency is not liable for any Client who is denied boarding, entry, or transit, or who otherwise incurs loss due to inadequate travel documentation, missing visas, or failure to meet health entry requirements.
5. Pricing and Itinerary Changes
Prices are based on rates in effect at the time of quotation and are subject to change by Suppliers until full payment is received and the Booking is ticketed/confirmed.
Airlines, hotels, and other Suppliers may change flight times, routings, accommodations, or itinerary details after Booking. We will make reasonable efforts to notify you promptly of any changes we are made aware of, but we are not liable for Supplier-initiated schedule changes.
Where a Supplier significantly changes or cancels a Travel Service, your rights (rebooking, refund, compensation) are governed by that Supplier's own conditions of carriage/contract, and, where applicable, consumer protection or package travel regulations.
6. Client-Initiated Cancellations and Changes
Cancellation and change requests must be submitted in writing (email) by the Lead Traveler.
Cancellation and change fees imposed by Suppliers (e.g., airline change fees, non-refundable hotel rates, cruise cancellation schedules) apply in addition to the Agency's own service fees, and are disclosed at the time of booking where available from the Supplier.
The Agency charges a non-refundable service fee of $[amount] per Booking/change for processing cancellations or amendments, regardless of whether the Supplier issues any refund.
Refer to Part II — Payment Terms & Conditions for how refunds are processed and applied to your original payment method.
7. Agency-Initiated or Supplier-Initiated Cancellations
If a Supplier cancels or becomes unable to provide a Travel Service (including due to insolvency), the Agency will assist in seeking any available refund, rebooking, or compensation from the Supplier, but does not guarantee recovery of funds already paid to that Supplier.
If the Agency itself is unable to fulfill a confirmed Booking due to circumstances within its control, we will offer a comparable alternative where possible or a full refund of Agency fees paid.
8. Travel Insurance
We strongly recommend that all travelers purchase comprehensive travel insurance covering, at minimum, trip cancellation/interruption, emergency medical treatment and evacuation, baggage loss, and travel delay.
If you decline to purchase travel insurance, you accept sole responsibility for financial losses that such insurance would otherwise have covered, including but not limited to cancellation fees, medical costs abroad, and trip interruption expenses.
Travel insurance policies are underwritten by third-party insurers. Claims, coverage decisions, and disputes are governed solely by the insurer's policy terms; the Agency is not a party to the insurance contract and cannot guarantee claim approval.
9. Special Requests and Assistance
Special requests (dietary requirements, accessibility needs, seat preferences, room type, connecting rooms, etc.) will be passed on to the relevant Supplier but are not guaranteed unless explicitly confirmed in writing by the Agency as a guaranteed feature of the Booking.
Travelers with disabilities or medical conditions requiring special assistance should notify the Agency at time of booking so we can communicate needs to Suppliers; however, provision of such assistance remains subject to Supplier policy and capability.
10. Client Conduct and Denied Boarding/Service
The Agency is not responsible for any Supplier's decision to deny boarding, remove a traveler from a flight/ship/tour, or refuse service due to the traveler's conduct, intoxication, documentation issues, health condition, or violation of Supplier policy.
No refund will be provided by the Agency where a Travel Service is terminated or denied due to the Client's own conduct or non-compliance with Supplier rules.
11. Liability and Limitation
To the fullest extent permitted by law, the Agency's liability for any claim arising from a Booking is limited to the amount of Agency service fees paid by the Client, except where liability cannot be excluded or limited under applicable consumer protection law.
The Agency is not liable for indirect, incidental, or consequential damages, including but not limited to lost wages, missed connections, loss of enjoyment, or emotional distress, arising from Supplier delays, cancellations, or service failures.
Nothing in these Terms excludes or limits liability for death or personal injury caused by the Agency's negligence, or for fraud, or any other liability that cannot be excluded under applicable law.
12. Force Majeure
Neither the Agency nor any Supplier is liable for failure to perform, or delay in performing, any obligation due to events beyond reasonable control, including but not limited to natural disasters, extreme weather, pandemic or public health emergency, war, terrorism, civil unrest, government action, strikes, or airspace closures.
In such events, remedies (rebooking, credit, refund) are governed by the relevant Supplier's policies and applicable law, and the Agency will assist the Client in pursuing these remedies but does not guarantee a specific outcome.
13. Complaints
Complaints about a Travel Service should first be raised with the Supplier directly (e.g., hotel front desk, airline representative) at the time the issue arises, so it may be resolved promptly.
If unresolved, please submit a written complaint to the Agency at [email] within [X days] of the completion of travel, including all relevant documentation. We will investigate and respond within [X business days].
14. Privacy and Data Use
Personal information (including passport details, payment information, and health/dietary information relevant to travel) is collected solely to arrange and administer your Booking and is shared with Suppliers only as necessary to fulfill the Booking.

15. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from these Terms or a Booking shall be subject to the exclusive jurisdiction of the courts of the State of Florida, except where mandatory consumer protection law provides otherwise.
16. Amendments
The Agency reserves the right to update these Terms from time to time. The version in effect at the time of your Booking confirmation will apply to that Booking.
17. Acceptance
By making a Booking, submitting a deposit, or accepting a confirmation/itinerary from the Agency, you confirm that you have read, understood, and agree to these Booking Terms & Conditions, our Payment Terms & Conditions (Part II), and our Privacy Policy, on behalf of yourself and all travelers named on the Booking.
Part II — Payment Terms & Conditions
These Payment Terms & Conditions ("Terms") govern all payments made to Above the Standard Travel ("we," "us," "our Agency") for travel products and services booked on your behalf, including but not limited to flights, accommodation, cruises, tours, transfers, and travel insurance ("Travel Services"). By making a booking and providing payment, you ("the Client," "you") agree to be bound by these Terms, together with our Booking Terms & Conditions (Part I of this document).
1. Accepted Payment Methods
We accept payment via major credit cards (Visa, Mastercard, American Express, Discover), debit cards bearing a major card network logo, and other methods disclosed at the time of booking. All payment card transactions are processed through a PCI-DSS compliant third-party payment gateway. We do not store full credit card numbers on our systems.
2. Cardholder Authorization
By providing credit or debit card details, you confirm that you are the authorized cardholder, or have the express permission of the cardholder, and that the billing information provided is accurate.
We reserve the right to request a signed credit card authorization form and a copy of a valid government-issued photo ID and/or the physical card before processing payment, particularly for high-value bookings, third-party card use, or transactions flagged by our fraud-prevention systems. Failure to provide requested verification within the requested timeframe may result in cancellation of the booking without penalty to the Agency, and any applicable supplier cancellation fees will apply to the Client.
3. Deposits and Final Payment
A non-refundable deposit is required at the time of booking to confirm reservations, unless otherwise stated in your booking confirmation. Final payment is due per the supplier's payment schedule stated on your itinerary/invoice. If final payment is not received by the due date, the Agency reserves the right to treat the booking as cancelled by the Client, and standard cancellation fees will apply. Certain suppliers (e.g., cruise lines, tour operators, low-cost carriers) may require full payment at time of booking; this will be disclosed prior to confirming your reservation.
4. Currency and Pricing
All prices are quoted in USD unless otherwise stated. If your card is issued in a different currency, your card issuer will convert the charge at its own exchange rate and may apply a foreign transaction fee; the Agency is not responsible for currency conversion fees charged by your bank or card issuer. Prices are subject to change prior to full payment due to currency fluctuation, fuel surcharges, tax changes, or supplier repricing, except where a fare/rate has been fully paid and ticketed/confirmed.
5. Card Surcharges and Processing Fees
A card processing fee may apply to payments made by credit card, disclosed to you prior to payment and itemized on your invoice/receipt. Wire transfers may incur separate bank handling fees, which are the responsibility of the Client.
6. Cancellations, Changes, and Refunds
Cancellation and change fees are set by the relevant airline, hotel, cruise line, tour operator, or other supplier, and are in addition to any Agency service fees. The Agency charges a non-refundable service/booking fee per booking/change, regardless of supplier refund policy. Refunds, where permitted by the supplier, will be credited back to the original form of payment and may take a period of time to appear on your statement, depending on your card issuer. We strongly recommend purchasing travel insurance to protect against cancellation, interruption, and medical costs.
7. Chargebacks and Disputes
If you believe a charge was made in error, you agree to contact us directly before initiating a chargeback with your card issuer, so we may attempt to resolve the matter. Filing a chargeback for services that were rendered as booked, or for supplier-imposed cancellation/change fees disclosed at time of booking, may be contested by the Agency with supporting documentation. Fraudulent or bad-faith chargebacks may result in the suspension of your account, referral to collections, and/or legal action to recover funds plus associated fees.
8. Fraud Prevention and Data Security
We use industry-standard encryption and PCI-DSS compliant processing to protect your payment information, and reserve the right to delay, decline, or cancel any transaction flagged as high-risk or potentially fraudulent, pending verification. We will never ask you to send full card numbers, CVV codes, or card PINs via unsecured email or text message. Please contact Erica McEachern immediately if you receive such a request purporting to be from us.
9. Third-Party Supplier Terms
Your booking is also subject to the individual terms and conditions, fare rules, and payment policies of the airline, hotel, cruise line, tour operator, or other supplier providing the Travel Services, which may include additional restrictions on payment, refunds, and changes. In the event of a conflict, the supplier's terms will govern with respect to the specific Travel Service they provide.
10. Agency Role and Liability
Above the Standard Travel acts as an intermediary/agent between the Client and the Travel Service suppliers, and is not the provider of the underlying transportation, accommodation, or other travel services. The Agency is not liable for the acts, errors, omissions, delays, cancellations, or financial failure of any third-party supplier. Payment processed through us does not constitute a guarantee of supplier performance.
11. Force Majeure
The Agency is not responsible for payment disputes, delays, or service disruptions arising from events beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, strikes, or supplier insolvency.
12. Acceptance
By submitting payment, you confirm that you have read, understood, and agree to these Payment Terms & Conditions, in addition to the Agency's Booking Terms & Conditions (Part I) and Privacy Policy.
